Employment Terms and Conditions
For Job Seekers
- Fees: Job seekers will not be charged any fees for services, such as job matching, resume writing guidelines and pre-interview preparation
- Third-party Fees: Job seekers are responsible for any third-party fees that may be required to obtain employment, such as skill enhancement training, background checks, drug tests, or certifications.
- Agreement: By using the Aptech staffing agency’s services, job seekers agree to the terms and conditions set forth in any contracts or agreements provided by the agency.
For Employers
- Fees: Employers will be charged a fee by the Aptech Staffing, for any job placements made through the agency, which will be based on the type of placement and the agreed-upon fee structure.
- Payment Terms: Employers agree to pay the staffing agency the placement fee within a specified timeframe after the candidate is hired.
- Cancellation: Employers may be required to pay a cancellation fee if they withdraw a job offer or terminate an employee within a specified timeframe after the placement is made.
- Agreement: By using the staffing agency’s services, employers agree to the terms and conditions set forth in any contracts or agreements provided by the agency.
Confidentiality and Non-Disclosure Terms and Conditions
- Confidential Information: The Aptech staffing, and all parties involved acknowledge that during the recruitment process, confidential and proprietary information may be shared. This includes, but is not limited to, trade secrets, business plans, financial data, customer information, and other sensitive information.
- Obligation of Confidentiality: All parties, including the Aptech Staffing, job seekers, and employers, agree to maintain strict confidentiality regarding any confidential information shared during the recruitment process. This obligation remains in effect during and after the termination of the recruitment relationship.
- Non-Disclosure: All parties agree not to disclose, divulge, or share any confidential information obtained during the recruitment process without the express written consent of the disclosing party, unless required by law or as part of the legitimate recruitment process.
- Authorized Use: Confidential information received by job seekers should only be used for the purpose of evaluating and applying for the specific job opportunity. Job seekers shall not use or disclose the confidential information for any other purpose or benefit, including competing with the employer or the Aptech Staffing.
- Return or Destruction of Information: Upon request or at the end of the recruitment process, all parties shall promptly return or destroy any confidential information received, including copies, notes, or other materials containing such information, unless otherwise agreed upon in writing.
- Exceptions: The obligations of confidentiality and non-disclosure shall not apply to information that: (a) is already in the public domain at the time of disclosure; (b) becomes publicly available through no fault of the receiving party; (c) was already lawfully in the possession of the receiving party prior to disclosure; (d) is independently developed by the receiving party without reference to the disclosed confidential information; or (e) is required to be disclosed by law, regulation, or court order.
- Survival of Obligations: The obligations of confidentiality and non-disclosure shall survive the termination of the recruitment process or any related agreements between the parties.

- Modifications to these Terms and Conditions: The staffing agency reserves the right to update or modify these terms and conditions for job postings and descriptions. Any changes will be effective upon posting on the agency’s website, and job seekers are encouraged to regularly review the terms and conditions.
